Current WHS Legislation in NSW (2025): Employer Duties

Under the Work Health and Safety Act 2011 (NSW), employers (PCBUs – Persons Conducting a Business or Undertaking) have a legal duty of care to:

  • Ensure the health and safety (physical and psychological) of all workers.

  • Identify and manage risks to wellbeing – including psychosocial hazards like stress, burnout, or exclusion.

  • Provide a work environment that promotes whole-person wellbeing.

  • Comply with SafeWork’s Code of Practice: Managing Psychosocial Hazards at Work (including workload, autonomy, recognition, and inclusion).

➡️ This explicitly includes promoting inclusion and minimising harm arising from isolation, lack of support, or cultural exclusion.


Employee Responsibilities:

Employees must:

  • Take reasonable care of their own health and safety.

  • Follow safe work procedures.

  • Report hazards or wellbeing concerns.

  • Cooperate with employer health and safety efforts.
